The news that came out of Texas over the weekend was almost too much to take especially after a series of grim headlines of mass violence that have rocked the country recently. We don't know what caused the driver to plow his SUV. You know, a crowd of migrants waiting at a bus stop in Brownsville on Sunday, killing 8. But tonight he has been charged with 8 counts of manslaughter. The suspect described by police as having an extensive rap sheet near Dallas. There is new information about a man who shot into crowds at a shopping mall Saturday. Also killing 8. His social media postings revealing extremist views towards women, Jews and racial minorities and offering a glimpse into his mental health struggles among those killed in the mall rampage. A couple and their young child. That's where we start tonight with Morgan Chesky. >> 48 hours after a gunman unleashed terror at an Allen Texas mall. But having a all right, troubling details emerging about 33 year-old Monday. She'll Garcia the shooter. >> Investigators say is seen in the surveillance video stepping out of his car and opening fire on innocent shoppers, killing 8 people and wounding 7 more. Authorities say Garcia was armed with a rifle handgun and wearing a tactical vest which David Ramirez says led to a frightening confusion. >> I thought it was that there was a police officer White since all the gear he was wearing even had a little patch in security is something. >> One patch on Garcia's best used by far-right extremist groups leading investigators to a disturbing online history on a Russian social networking site where Garcia shared pictures of the Allen premium outlets where the attack took place. Sophia Mendoza lost their lives in the shooting. Their mother, Hilda remaining in critical condition, also killed the Cho family. Cindy Q and 3 year-old son James, leaving 6 year-old William as the family's only Survivor Ash war at icon to a 27 year-old engineer and 20 year-old security guard Christian the core. >> It was such a loving guy that's getting out. >> Tonight, the crosses flowers in tears we've seen before coming to Allen, a community clinging to whatever it can. >> All of it so senseless. What we know. >> Yeah, Lester Army officials have confirmed that Garcia did enlist in the Army back in June of 2008, but he was kicked out barely 3 months later due to one ounce of unspecified mental or physical condition. But tonight here at the scene, hundreds are showing up to pay their respects and crosses have been directed to pay tribute to those 8 lives lost Luster. >> All right, Morgan, thank you. Also in Texas, criminal charges were announced against the suspect accused of plowing his SUV into a crowd of migrants killing 8 of them and injuring 10 others. Gabe Gutierrez reports from Brownsville, Texas. >> Tonight, the driver seen in this surveillance video plowing into a group of people outside a migrant shelter in Brownsville, Texas is facing manslaughter charges. >> The SUV ran a red light, lost control, flipped on its side and struck a total of 18 individuals. >> Jorge Alvarez is now charged with 8 counts of manslaughter. 10 counts of aggravated assault and is being held on 3.6 million dollars bail. Police say he has an extensive criminal record and is not cooperating. Now 8 men are dead. 10 others injured migrants from Venezuela. That's the right. Police say the driver blew past. Now makeshift memorial has sprung up right here at the bus. Stop. Authorities say there's not yet a clear motive here, but they haven't ruled out that this could have been intentional. It was he and what did he say? This man who says he witnessed the crash tells us the driver appeared drugged and yelled anti immigrant profanities as he tried to flee the scene. The police have not confirmed that weighing on formal college reports. The migrant deaths come as tensions ramp up here. Diaz from the lifting of the COVID border restriction known as title. 42. The change expected to bring yet another migrant influx in just the past 72 hours. The Border Patrol chief says there been more than 26,000 illegal border crossings and after the White House announced 1500 troops to the border to help with administrative task. Today, Republican Texas Governor Greg Abbott announced he was deploying a specialized task force of hundreds more National Guard members to turn back migrants. >> President Biden is laying down and they would welcome an people across the entire world saying that the United States and water is wide open. >> Today in Brownsville, with family members in agony, a prayer vigil for the 8 men who died and those who remain in critical condition. This man telling us they endured a grueling journey through dangerous terrain only to die here. >> We see it. What have we done to deserve this? Lawyers for aging Carolyn, Donald Trump facing off in closing arguments. A growing outcry over that deadly chokehold on a New York subway calls for charges while lawyers for the writer who said do them and say he acted in self-defense. Emilie Ikeda has more. We have to warn you, the video is quite disturbing. >> Protests demanding justice for Jordan Neely flooded subway tracks leading to a chaotic clash with police and more than a dozen arrests this weekend. Today marks one week since the chokehold killing of the homeless street performer on the subway. >> You can look at it. I see that you knew he was about to die. >> Really suffered from mental illness. Sources say he was on a list of the most at-risk homeless men in the city. >> We need alternatives for these individuals. So they're not relegated to that kind of life. So those of us in government that is a wake-up call. >> The man seen holding Neely in that deadly chokehold is 24 year-old college student, a Marine veteran Daniel Penny. He was questioned by police but not charged while the others appearing to assist have not been publicly identified by authorities. According to 2 sources, the Manhattan da will decide whether to present the case to a grand jury to vote on potential charges later this week. >> The critical question is just going to be what was Mister Neely doing and did it give rise for any reasonable basis? >> For Mister Penny to to take them down and put in a chokehold before help arrived. A source told WNBC several 9-1-1 callers reported a man making threats on board. Attorneys for Penny say he with the help of others acted to protect themselves. Adding Penny didn't intend harm and pointing out the least past behavior, which includes more than 40 arrests according to police. But today, lawyers for Neely's family saying >> with this and with no charges against Daniel Penny, how can anyone feel safe? >> As protesters promise to return to the subway station, Emily had a NBC News New York. >> A new confession from convicted killer Alec Murdock. He's now admitting to lying about his housekeepers deaths. Katie Beck explains. >> Another South Carolina legal battle brewing with Alec Murdock at the center. I did a lot of them. >> And again, the convicted double murderer admitting he didn't tell the truth. Just more stand by him. The controversy surrounds the death of Murdoch's former housekeeper Gloria Satterfield who died after a fall at the Murdoch home in 2018. Maggie Murdoch discovered her body at the bottom of a brick staircase. Housekeeper has fallen. There has to Satter field later died at the hospital from prison. Alec Murdock now responding to a lawsuit from the insurance company seeking to recover the 3.8 million dollar wrongful death judgment. Murdoch saying he fabricated his initial story that is dogs caused the fall. No dogs were involved saying he invented the scenario to force his insurers to make a settlement payment. Satter Field. Family attorneys are fighting back releasing this audio recording of Murdoch's initial account to insurance investigators. >> When you were talking with the glory before she was taken away, that she did, she describe the chain of events in any way to go. The government's new plan and when you might see that money and later the rush is on with the record melt under way. Why so many are now searching for gold. Joe says Americans are preparing for the summer travel season. President Biden today unveiled a plan to force the airlines to compensate passengers with cash when flights are significantly delayed or canceled. But could this lead to higher ticket prices? Here's Tom Costello. >> The White House plan calls for compensating passengers with cash meal and hotel vouchers. When delays or cancellations are the airlines fault? Not weather related including mechanical issues, Chris scheduling or shortages computer failures. >> American air travelers deserve better. Your time at the impact on your life matters. >> The proposed rule comes after last summer's travel chaos when 20% of flights were delayed. >> And stressful as a lot of money that you don't get behind >> Then Southwest Airlines, mega meltdown over the winter break. >> There's no hotels. There's no rental cars. There's just people. >> Cancel flights everywhere. The DOT Web site flight writes, Dot, Gov. Listing each airline's voucher and refund policies will now include whether they compensate passengers. So far, none does. But a shortage of 3,000 air traffic controllers also contributes to delays. The FAA is causing delays and cancellations. Shouldn't they be compensating passengers as well? >> Well, when airlines make billions of dollars in profit running their business, selling U.S. tickets, they need to honor their responsibilities under that ticket. >> The airlines received billions in taxpayer bailout money during the pandemic now warned the new rule would cost passengers more. >> Airfares are going to rise, plain and simple. It also creates a one size fits all solution that doesn't allow our carriers to compete with each other. >> The compensation plan will not be in effect for the summer's travel stress test. >> This is a proposed rule which makes the FAA will solicit feedback from passengers and the airlines and this process will take months if not longer before ever takes effect roster. Okay, time. Thank you. >> Up next, the debate over reparations as one major state takes a big step forward toward potentially making them a reality. California is moving closer to possibly compensating the descendants of slaves. The state's reparations task force approved a final recommendation on who could be eligible for hundreds of thousands of dollars. But is it the right approach? It was just a little overwhelming. >> The vital lineage information could be valuable in California as it debates. What is to descendants of the enslaved? Camila Morris chair of the California Reparations Task force, the first in the nation statewide effort to address systemic racism against African-Americans caused by the enduring legacy of slavery. Could be something as simple. As you take a cheek swab, you submit your DNA may go up. You're a descendant of enslaved person. Here's your check. >> I mean, it could be again, this is all still a work in progress. >> The task force wants eligibility to be lineage based versus race-based. That has sparked debate the paper trails. Not always proven to be correct for people who have to prove their lineage. It can be difficult, costly and time-consuming, especially since many slaves weren't identified by name but property codes up until the 18, 70 census. >> People think that ongoing to sit down and do my family research this weekend and and get my application for reparations ready. That's not going to happen. >> Over the weekend, the task force approved recommendations for reparations that could be worth up to 1.2 million for eligible applicants. Citywide reparations efforts are also underway in Boston. St. Louis in San Francisco. Some may not support the idea because it could cost taxpayer dollars. Denise doesn't know if she'll ever get reparations, but she supports the Golden State's effort. >> I'm excited for people who you know were needed and can use it.
